Agreement

These Terms of Service (“Terms”) govern your access to and use of the website and related online services operated by FOF Records (“FOF,” “we,” “us,” or “our”) at https://fofrecordlabel.com (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site in connection with any commercial or paid offering. You represent that the information you provide is accurate and that you have authority to act on behalf of any artist, project, or business you name.

Not legal or financial advice

Content on the Site is for general information. It is not legal, tax, or investment advice. You should consult qualified professionals for advice specific to your situation.

Our services; no guaranteed outcomes

FOF Records provides label, marketing, and related creative services. Music industry outcomes (streams, playlist additions, chart positions, or revenue) depend on many factors outside our control. Unless we have signed a written agreement with you that expressly guarantees specific results, we do not guarantee any particular outcome from your use of the Site or from any service or product we offer.

Acceptable use

You agree not to:

• Violate any law or third-party rights, including copyright and trademark rights in music, artwork, or names.
• Use the Site to distribute malware, scrape or overload our systems, or probe for vulnerabilities without permission.
• Impersonate FOF Records, our artists, or any person or entity.
• Harass, threaten, or abuse us, our users, or our partners.

Accounts and email communication

Some features may open your email or messaging client (for example, an “apply” or contact flow). We do not control third-party email or messaging services. You are responsible for the accuracy of what you send.

Payments; third parties

Where payments are processed (including playlist placement orders), a third-party processor such as Stripe may handle payment and related data. Their terms and privacy policy also apply. See our Refunds & payments and Playlist placement terms for purchase-specific terms.

Intellectual property

The Site, branding, text, design, and other materials (excluding your submissions) are owned by FOF Records or our licensors. You may not copy, modify, or distribute them without our prior written permission, except as allowed by law or for personal, non-commercial use that does not harm our rights.

You retain ownership of content you submit. You grant FOF Records a non-exclusive license to use what you submit only as needed to respond to you, provide any service you request, and operate the Site, unless a separate signed agreement provides otherwise.

Disclaimers

THE SITE AND ANY CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, FOF Records DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FOF Records AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR ANY SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SITE (EXCEPT WHERE PROHIBITED BY LAW) SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100), IF NO SUCH PAYMENT APPLIES.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum the law allows.

Indemnity

You will defend, indemnify, and hold harmless FOF Records and our personnel from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Site, your content, or your violation of these Terms, except to the extent caused by our willful misconduct.

Governing law; venue

These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in South Carolina, except where applicable law requires otherwise.

Changes

We may update these Terms. We will post the revised version on the Site and update the “Last updated” date. Your continued use after changes means you accept the new Terms, to the extent permitted by law. If you do not agree, stop using the Site.
